Child Offences

Definition

Any person who has attained the age of sixteen years and has responsibility for any child or young person under that age, wilfully assaults, ill-treats (whether physically or otherwise), neglects, abandons, or exposes him, or causes or procures him to be assaulted, ill-treated (whether physically or otherwise), neglected, abandoned, or exposed, in a manner likely to cause him unnecessary suffering or injury to health (whether the suffering or injury is of a physical or a psychological nature), that person shall be guilty of an offence, and shall be liable

Points to Prove

- Be a person aged 16 years or older
- Who has responsibility for any child or young person under that age
- Wilfully assault, ill-treat (whether physically or otherwise), neglect, abandon or expose that person
- In a manner likely to cause them unnecessary suffering or injury to health

Powers & Punishment

On conviction on indictment, to a fine or alternatively, or in addition thereto, to imprisonment for any term not exceeding 10 years;

On summary conviction, to a fine not exceeding £400 pounds, or alternatively, or in addition thereto, to imprisonment for any term not exceeding six months.
