This power allows officers to stop and search persons, vehicles, and items in public places.

  • Search for stolen or prohibited articles
  • Includes weapons, corrosives, and prohibited fireworks
  • Applies to vehicles and persons
  • Items can be seized if suspected unlawful

Reasonable grounds are required — this is not a suspicion-less power.

  • Suspected possession of weapons or knives
  • Suspicion of burglary tools / going equipped
  • Belief a person holds stolen property
  • Possession of corrosive substances in public
  • Illegal possession of fireworks

Applies in public places and locations with public access.

Does not normally apply inside dwellings. Extra rules apply on private land.

3. Dwelling Safeguards:

  • Person must not reside at the address
  • Must not have permission to be there

  • Search person, vehicle, and contents
  • Detain for purpose of search
  • Seize suspected unlawful items

5. Prohibited Articles:

  • Offensive weapons
  • Items made or intended for crime
  • Includes burglary, theft, TWOC, fraud, and criminal damage offences
